APPOINTMENT OF MIGORI COUNTY ATTORNEY

 Migori County Assembly yesterday, upheld the appointment of nominee Gladiolus Oluoch Otieno for the position of County Attorney after a long awaited period by the County executive.

The speaker of Migori County Assembly Charles Oyugi, had earlier issued a notice for the vetting of nominee for the position of County Attorney pursuant to the provision of the Migori County Standing Order No. 185 as well as section 7 of the public appointments.

The report was laid to the floor of the House by Member for South Kanyamkago Ward, Angogo Graham Kigali who stated that the name of the nominee was presented to the committee on appointment in accordance with the law.

In considering the nominee, the committee of Appointments was guided by article 73(2) (a) (b) (c) and (e) of the constitution, the County government Act, the office of County Assemblies Act, provision of section 7 of the public Appointments Approval Act of 2017.

The report stated that the committee relied on the following terms of reference in appointing Mr. Gladiolus Oluoch; criteria for shortlisting Mr. Oluoch, examining if he complied with constitutional requirements and examining his suitability to hold the office of County Attorney (his credentials).

In compliance with provision of Chapter 6 of the constitution of Kenya 2010, nominee Gladiolus Oluoch presented the documents from the following institutions for clearance status for vetting process: Kenya Revenue Authority, Criminal Investigation Department, The Higher Education Loans Board, Credit Reference Bureau and Ethics and Anti- corruption Commission.

As provided for in the section 1(9) of the Public Appointments County Assembly Approval Act of 2017, the report stated that the committee was to conduct an approval hearing of Mr. Gladiolus Oluoch to determine his suitability within 21sitting days.

The Committee findings about the nominee:

The committee found out that the nominee had a Bachelor’s Degree in law from University of Nairobi in the year 2002 and Diploma in law from Kenya School of Law 2006 and so he qualified academically.

The nominee had acquired a 22 year experience of which 13 years he was working in managerial positions.

Then nominee met the requirements of Chapter 6 of the constitution of Kenya 2010.

The nominee had strong linkages both nationally and internationally.

The nominee garnered 61.4% out of 100 in regards to his suitability to hold the office of county Attorney.

 The Committee recommendations about the nominee

According to Section 5 of the office of County Attorney Act No. 14 of 2020 and section 8 (a) (b) and (c) of the Public Appointments County Assembly approvals Act 2017, the committee certified that Mr. Gladiolus Oluoch was suitable for the appointment and recommended that he is approved for the position of Migori County Attorney. 

Member for Central Sakwa ward Esther Migose Auma, seconded the motion saying that Migori County is in serious need of a County Attorney and that Mr. Oluoch had all the expected requirements that takes to be appointed for the position.

After the motion was moved by Member for South Kanyamkago ward Angogo Graham and seconded by Member for Central Sakwa ward Esther Migose, the deputy speaker Hon Chacha proceeded to propose to the house on adoption of the committees report on appointment and vetting of the Mr. Oluoch to the position of County Attorney. This was pursuant to the county government Act of 2012 section 58(a) 2(d),the Public Appointments, County Assemblies Approval Act of 2017 section 4 and 9, Standing Order No. 180.      

Member stood to debate the tabled motion. Member for Kachieng ward Brian Odhiambo, stated that the nominee’s names differs ranging from the passport, certificates and police clearance certificates and even dates indicated on the documents were contradicting.

Member for Central Kamagambo ward Akal Jacob Caleb requested the house to serious and not tolerate documents that are not authentic. He requested the Committee of Appointments to always be keen and bring proper reports to the house.

Member for North Kamagambo ward Oluoch Oseme, requested the mover to clarify who the nominee was. He called for the nominee to submit a sworn affidavit as to clear his names.   

Member for Ntimaru West ward Wambura Caleb insisted that despite everything, there is need to move with speed as to appoint a County Attorney since the county was battling with so many legislation issues.

After the motion was debated, the Deputy speaker proceeded to put a question pursuant to the County government Act of 2012 Section 58(a) 2(d) the Public Appointments County Assemblies Approval Act 2017 Section 4 and 9. The Standing Order No. 180. The house adopted the appointment of Mr. Gladiolus Oluoch for the position of Migori County Attorney.
